These terms and conditions outline the rules and regulations for the use of Emily Rose Quirky Designs Website and affiliated Etsy & Sum Up online shop websites.

By accessing these websites Emily Rose Quirky Designs assumes you accept these terms and conditions in full. Do not continue to use Emily Rose Quirky Designs website, ERQuirkyDesigns Etsy Shop & Emily Rose Quirky Designs Sum Up Store if you do not accept all of the terms and conditions stated on this page.

All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of ERQD’s assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services/products, in accordance with and subject to, prevailing law of United Kingdom. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

Terms and Conditions of Sale for online ordering: 
These are the terms and conditions in which Emily Rose Quirky Designs supplies products to you, whether via the ERQD website or via ERQD’s other Etsy and Sum Up online shops to make a purchase. Please read through these terms and conditions carefully before placing your order. By placing an order, I assume you accept these terms and conditions in full. Do not place an order if you do not accept all of the terms and conditions stated on this page. As previously stated I reserve the right to change these terms and conditions at any time. It is your responsibility to read the terms and conditions on each occasion you order online and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.

ORDER PLACEMENT

1. 1) https://www.emilyrosequirkydesigns.com , 2) https://www.etsy.com/uk/shop/ERQuirkyDesigns , 3) https://emilyrosequirkydesigns.sumupstore.com - The customer must first use either website 2 or 3 to make a purchase. (Website 1 is not an ecommerce website.)
    
2. Having accessed website 2 or 3 listed above the customer can view ERQD products and click on an item/s to view a larger thumbnail of the product alongside with a product description for that specific item/s. 

Gift wrapping Extra Option Technicalities 
Due to limited functions on Etsy and Sum Up please see the terms below and how to apply these options to orders.

Standard Gift Wrapping & Christmas Gift Wrapping
Orders do not automatically come with Gift Wrapping or Christmas Gift Wrapping this is an extra charged service and prices are clearly listed on the websites. Both of these extras only apply to the entity of the order and not for individual items within the order. (However items in the order may be wrapped individually and placed into one package due to the fragility of some items needing extra protective packaging.) If opting for Standard Gift Wrapping or Christmas Gift Wrapping the customer/recipient will receive a printed gift receipt with the item/s not displaying any prices unlike an order receipt. *Allowing that I have received all the relevant personalised text details, dispatch time for this service will be the usual 1 business day (24 hours) from receiving the order. (The customer acknowledges that if they have not supplied their personal message I will assume they have missed this process and I will contact them to ask for this which will result in a delay in their dispatch.)*

Standard Gift Wrapping 
The price for Standard Gift Wrapping is clearly stated on the websites as £1 extra (ERQD holds the right to alter this cost or remove this option at any given time).
Standard Gift Wrapping includes: 

• Items wrapped in brown wrapping paper stamped with the ERQD Logo.
• ERQD business card secured to wrapping with colourful washi tape. 
• A6 leaflet one side displaying ERQD logo + reverse space for personal message *300 characters max*.
• All items (cards, decorations prints & frames pieces) will be packaged into board backed envelopes or cardboard parcels.

Applying Standard Gift Wrapping

Etsy Standard Gift Wrapping - Customers can add this when viewing their basket by clicking “this order is a gift” and selecting Etsy Standard Gift Wrapping and will be able to input a personal message in a box below. 

Sum Up Store Standard Gift Wrapping - Due to the site's limitations this will be listed as an individual item to add to the Cart. (See the item description before adding for what text you will need to provide for your personal message.) When in the Shopping Cart please use the “Message for the Merchant” box in order to type the personal message.

Christmas Gift Wrapping
The price for Christmas Gift Wrapping is clearly stated on the websites as £2 extra (ERQD holds the right to alter this cost or remove this option at any given time).

Christmas Gift Wrapping includes: 

• Items wrapped in brown wrapping paper stamped with the ERQD Logo.
• Items secured with red & white twine for a festive touch.
• An ERQD business card including inside the wrapped package.
• A brown label, one side presenting the ERQD stamped logo and the reverse for personalisation - To *Name* Merry Christmas From *Name* (Names can be input only).
• An A6 leaflet one side displays ERQD logo and the reverse has space for personal message *Label & Leaflet Message combined are 300 Characters max*.
• Decorations only will be placed inside turquoise parcel boxes (subject to availability). 
• All other items such as cards, prints and framed pieces will be packaged into board backed envelopes or cardboard parcels.

Applying Christmas Gift Wrapping

Etsy Christmas Gift Wrapping - Due to the site's limitations this will be an individual item listing to add to the basket. (See the item description before adding for what text you will need to provide for your label & personal message.) When in the basket please use the “Add a note to ERQuirkDesign” box in order to type the label & personal message text.

Sum Up Store Christmas Gift Wrapping - Due to the site's limitations this will also be listed as an individual item to add to the Cart. (See the item description before adding for what text you will need to provide for your label & personal message.) When in the Shopping Cart please use the “Message for the Merchant” box in order to type the label & personal message.

Order Placement continues below:

1. Customers begin to place an order for an item/s by either clicking add to basket/cart. You can then click at the top right hand corner of the websites on the basket or cart icon that will take you to your item/s . Items are not reserved by the customer when adding to basket/cart, only when the order has been placed, payment has been issued and an email confirmation has been received is that item assigned to you (Items are subject to availability). 
   
   - On the Etsy basket page you may wish to add a coupon code if you have one (subject to terms & conditions, please see Coupons T&C section below).  
    
2. The customer can conclude the checkout process which requires personal details to be completed such as Name/s, Email Address, Contact Number, Shipping Address and finally your chosen method of payment. You will then receive an email to acknowledge your order has been placed, it’s advisable customers check their junk inbox in case the email has been rerouted there automatically. (The email receipt is your proof of purchase ERQD encourages you to keep your receipt so that in the event of a return or similar matter this can be used as evidence you placed the order.)

Payment transactions
For ERQD’s Sum Up Store and Etsy online shops both transaction processes start once you have completed the order checkout. Please view Etsy or Sum Up for their T&C’s. 

WRITTEN COMMUNICATION
For contractual purposes, when you order products online, you agree to electronic means of communication.

PRODUCTS
The Etsy & Sum Up Store should provide you with all the information you need for an item in their description ERQD asks you to check these before making your purchase so you are accurate on the following. 

• Title / Name of Item 
• Item Materials 
• Item Size 
• Item Hazards 
• Handmade Item 

PRICES 
Prices are clearly displayed on ERQD’s shop websites, these include VAT and Free Royal Mail First Class Postage. These Prices may change from time to time and not all ERQD’s sites will display the same prices at once. If you have purchased ERQD products through one of our stockists, sadly I do not price match our products sold through other retailers. 

VARIATION
Each item is handmade by myself in the ERQD studio and I cannot guarantee that each item will look exactly the same as the imagery on the website due to slight variation and also your device settings(Brightness etc.) Each item is individual and therefore will vary slightly giving them a unique look.

PERSONALISED ITEMS
Products are clearly displayed in their descriptions whether an item can and cannot be personalised and how to add your text etc. Etsy personalisation text to be added in basket “Add a note to ERQuirkDesign” Sum Up Store personalisation text to be added in cart “Message for the Merchant”. 

• Personalised products take longer to be dispatched due to their character, please see individual item descriptions for estimated dispatch time for their T&C’s. 
• Unfortunately, personalised items cannot be returned, unless they are faulty.

STOCK UPDATES
Unfortunately I cannot always guarantee there will be more stock, please see new arrivals on the ERQD homepage for all the latest products and social channels for new stock drops.

SALES (Promo codes/ Coupons/ Percentage Sales & All Other Discounts) 
The sale/s applies to selected item/s only. Sale item/s will be clearly marked down unless using ERQD’s Sum Up Store due to website limitations will only display current price. 

• This sale offer cannot be used in conjunction with any other offer, discount or promotion unless stated otherwise.
• All products are subject to availability, ERQD reserves the right to withdraw any items and/or change these terms and conditions at any time.
• Postage, protective packaging and delivery charges are free of charge, however Standard Gift/Christmas Gift Wrapping is still an extra cost as is for non sale items also.
• This offer is non-transferable and there is no cash alternative.
• This offer is not valid in conjunction with any other offer, promotional code, student discount or employee discount.
• ERQD reserves the right to cancel or change this offer at any time, amend the terms and conditions or refuse an individual’s participation.

Sum Up Store
Unfortunately the Sum Up Store only offers to display one pricing figure per item, resulting in customers not being able to view if item/s have been reduced etc. ERQD will manually discount items to match Etsy price listings, however I cannot guarantee this will always be at the same time and Etsy may have different percentages off sales and multiple buy offers available.

Etsy
Fortuantly Etsy does have the option to add sale prices and display the original RRP. It's also possible to show customers various sales/percentages off on an item(s) or the whole shop.  

Coupons
Currently the ERQD Sum Up Store does not offer the use of promo codes(Coupons), however Etsy does have this feature. Etsy Coupon Codes are a great way to save a fixed discount rate on an item(s). This code will be displayed as an announcement on this website, Etsy's ERQuirkyDesigns shop and also across social media platforms.  

• An Etsy coupon code can be added at checkout, all you need to do is copy the coupon code and then when ready to checkout in your basket select apply shop coupon code and paste the code - this will give you the relevant discounts applicable. 
• Please see Etsy's help page (External hyperlink) if experiencing any issues. 
• If the code does not work please ensure it has been entered correctly and also the Terms and conditions for that code in the announcements to ensure that the code is still valid for your order and the items you are purchasing.

ORDER ISSUES

Customer Cancellation 
Unfortunately it is not possible to alter an order once an order has been placed, I am unable to cancel it, or make any changes to it. Please wait until you have received your order, and proceed by following the return procedure.

Customer Address Amendments
Regrettably, I am unable to change an order once it has been placed. The reason for this is because of the fast dispatch service I provide. Your item may already be with the courier to the destination on the order. For this reason if the customer has placed the order to the wrong address it is up to the customer to follow up with Royal Mail to establish where their item is. ERQD will assist by forwarding over the original postal receipt with any Royal Mail tracking numbers etc to the customer for their enquiry. The customer will need to pay any upfront fees with Royal Mail to have their item redirected to their desired address and this is also the case if the item is returned to sender (Emily Rose Quirky Designs). 

• Please ensure before you proceed to payment that you have double checked the delivery address on your order to the correct address. (Billing address is where your payment method is addressed too and Delivery/shipping address is the destination you wish your order to be sent).
  
   
• Please note that some devices automatically complete these details when using Apple Pay, Paypal or Amazon Pay and possibly other payment providers to avoid disappointment please edit your delivery detail to the correct destination. 

Where is my order

1.  Please check your order dispatched email, check your junk inbox in case it has been automatically rerouted there. Etsy will show this as a dispatch email and Sum Up Store will show this as the order is fulfilled, this means Royal Mail or the chosen courier now has the package and through their 1st class service aim to deliver the next working day. *However this cannot be guaranteed on their part so please allow plenty of time for any items needed urgently.*
   
    
2.  If it has been later than one business day and you have not received one of the emails above and there are no shop banner notices for delays, I ask customers to use the contact form to find the status of their order. 

Missing Item
I apologise if an item is missing from your order and ask you to be directed to the contact form on the website to advise ERQD of this. I do advise to check the following first:

1. Check your dispatch emails if you have been notified about your order - in some instances due to size or protective wrapping on certain items I may send items in separate packages and one might have reached you before the other is yet to. 
   
    
2. The item/s you ordered may have been out of stock. It is worth checking your emails (including your junk/spam) to see if we have sent you a cancellation email.

*If none of the above apply, please proceed to reach out to our contact email form on the Website.*

Incorrect item received
If you have been sent an incorrect item in your order, please reach out via ERQD’s Returns form and tell me which item you have been sent and the item you should have received so I can cross check the order placed and proceed with the return and dispatch the correct item on your order (subject to availability). 

• This must be done within the 30 day return window from when the order was placed.
• To help me look into this further I may ask you to send an image of the incorrect item received to prevent this from happening again in the future.
• As per Returns T&C the customer will need to print the postage label & return slip. 
• If the item on your original order is now out of stock you will receive a refund. 

ERQD Order Cancellations
Unfortunately, on the rare occasion during busier periods I may not know that stock isn't available until your order is being packed after your order has been placed, I will contact you via email to update you and see how to proceed accordingly ie. if any new stock is in the making/refunds/ exchanges. 

• I do advise that all items are subject to availability.
• Please be assured if your order has been cancelled you will be refunded for the order if you have chosen this option.
• If you are concerned about the above please feel free to reach out to us through the contact form.
   

DELIVERY

Dispatch Time

• ERQD will dispatch your items within 1 business day (24 hours) of the order being placed. 
  (For example - an order is placed at Thursday 5pm the order will be with Royal Mail by Friday 5pm). 
• Business days are Monday - Friday 9-5pm only. 
• This service is non inclusive of making the last postal collection that day. 

Exclusions include: 

• Standard Gift Wrapping & Christmas Gift Wrapping dispatch for this service will be 1 business day (24 hours) from receiving the order with all the relevant personalised text details. (The customer acknowledges that if they have not supplied their personal message I will assume they have missed this process and I will contact them to ask for this which will result in a delay in their dispatch.)
• Any Personalised Items as clearly shown in the items description will take longer to process please see individual listings for an estimated dispatch time. 
• If the websites present a shop banner or announcement at the top of the home/shop pages alerting customers about possible delays in order dispatches and the customer proceeds to place an order they have agreed to the terms stated in the announcement. (If the owner is on holiday and items will not be dispatched until a certain date or if there are known issues with the Royal Mail Service etc.)

Postage
All orders qualify for free Royal Mail UK delivery - this is for the entire order to be sent to one address. (This does not mean you can split your order items to be sent to multiple addresses, please complete another order if you wish to do this as many times as necessary.) 

• The free delivery discount is automatically applied.
• All orders will be sent via Royal Mail 1st Class, who aim to deliver the next working day. *However this cannot be guaranteed on their part so please allow plenty of time for any items needed urgently.*

• Other couriers may be used by ERQD, but only if ERQD has communicated this with the customer and they are fully aware of this. 
• This offer is non-transferable and there is no cash alternative.
• This is valid for UK deliveries only.
• This offer is not valid in conjunction with any other offer, promotional code, student discount or employee discount.
• ERQD reserves the right to cancel or change this offer at any time, amend the terms and conditions or refuse an individual’s participation.

Third Party Carriers for onward shipping
Please be aware I do not recommend involving a third party courier to receive your items to your final destination when placing an order through both my Etsy or Sum Up Store websites and  I do not take any responsibility for parcels that are sent with this method.

If you choose to use a third party carrier to distribute your items to you please know you do so at your own risk and I am unable to assist with any delivery issues such as damaged or missing items as I am unable to determine where along the transit process this issue occurred and the contract of sale is to the address provided on the order receipt. 

Item Packaging 

Prints

• All Prints are placed into a waterproof biodegradable sealed cellophane bag accompanied with a piece of recycled 1mm grey board to provide extra sturdiness and finally secured into an all board envelope. (Items may have ERQD logo stickers/business cards or price tags on packaging.) 
• For A3+ Large Prints these will be packaged in the same way and then secured into a cardboard parcel mailer.

Decorations

• All Decorations are placed into a waterproof biodegradable sealed cellophane bag, and finally secured into an all board envelope or a cardboard box. Clay items will be protected in a layer of biodegradable bubble wrap. (Items may have ERQD Logo stickers/business cards or price tags on packaging.) 

Framed Items

• All Framed Items have recycled 1mm grey board cut to size to shield the glass, completed with cardboard corner protectors and biodegradable bubble wrap to be watertight and protected. These will then be placed securely into a cardboard parcel. (Items may have ERQD Logo stickers/business cards or price tags on packaging.) 

RETURNS
Items must be in the 30 day window from when the order was placed to the present date for a refund/exchange to be issued.

• Return postage is free (this cannot be exchanged to an alternate address / nor exchanged for cash).
• You will need the original packaging or provide your own see terms below.
• You will need a printer in order to return an item (Postage label/return slip).
• Exchanges are subject to stock availability. 
• I do not accept returns/ exchanges on personalised items unless they are faulty.

The Return Process
Having checked your orders in the 30 day window to start a return and providing the items in its original condition you must complete a return form on this website. 

1. Once the form has been submitted you will receive an email within 48 hours, *possibly longer during busy periods* regarding whether you can proceed with a return. This email will have two attachments to print 1) A return slip to place inside with the item 2) A Royal Mail pre-paid postage label to place on your original packaging or your own packaging if you disposed of the original. *You will need a printer for these*. (If you are using your own packaging as you disposed of the original I expect you to provide similar protective packaging as the item arrived to you, if I find the item arrives damaged due to inadequate packaging and wasn’t listed as damaged or faulty in the return (nor any photo evidence of this) I can hold the right to not to issue a refund to the customer. 
    
2. Depending on the size of your return item will determine how you will post your return. 

• If an item can fit into a Royal Mail postbox or parcel box and you do not want a proof of postage certificate, you can opt for this. 
•  If an item is too large for post boxes please take this to your nearest Post Office or Royal Mail delivery Office (Hyperlinks to external sites).
•  If you wish to receive a proof of postage certificate you will need to take your item into a Post Office or Royal Mail delivery Office and request this free service. I recommend obtaining this for your records until all refunds are complete.  (Hyperlinks to external sites).

Before returning any item(s) to ERQD, we do ask that they are in the same condition that you received them, with tags still attached. Please take reasonable care to ensure that item(s) are returned safely and are not damaged in transit and include the original packaging and protective wrapping where possible.

Return Payments
Once having received your item(s) I will process your payment return, however, it can take up to 10 days from the date I received your return, and up to 20 days during my busy Christmas and Sale periods.

*Return payouts will be made back into the original payment method used for placing the order via Etsy or Sum Up unless this is not possible in which I will ask to use Paypal as a secure form of payment as this only requires an email address and receipts are easily available for both parties to acknowledge as evidence of a refund payment. When issuing refunds via Paypal it’s up to the customer to provide the correct email address and if they do not and the transaction cannot be cancelled the customer is liable for this.*

Faulty Returns
If you receive a faulty item please complete the Return form within the 30 day window of placing the order. Having completed the form it will then be decided whether the customer is to return the item following the same procedure above or to dispose of the item at their own discretion. *Return payouts will be made back into the original payment method used for placing the order unless this is not possible in which I will ask to use Paypal as a secure form of payment as this only requires an email address and receipts are easily available for both parties to acknowledge as evidence of a refund payment. When issuing refunds via Paypal it’s up to the customer to provide the correct email address and if they do not and the transaction cannot be cancelled the customer is liable for this.*

• Return postage is free (this cannot be exchanged to an alternate address / nor exchanged for cash).
• You will need the original packaging or provide your own see terms above in Returns.
• You will need a printer in order to return an item (Postage label/return slip).
• Exchanges are subject to stock availability.
• I may ask for you to attach in an email images of the damaged/ faulty item. 

*If you receive any shattered ceramic/clay items, please follow the process above. I will not ask for you to return these items in the post and instead ask you to dispose at your own discretion. I just ask that a photo be sent to the email address below returns@emilyrosequirkydesigns.com and I will refund the items for you.

New Return Slip/Postage
As long as you are within the 30 day return window as stated above, please just fill in another return form and explain the situation to begin the process. I will resend the postage label and return the slip via email. 

Gift Returns
Complete the return form and provide the order number which will be on your gift receipt. Once the process is complete and I have received your item I can offer a refund via the original payment method once the item is received. (ERQD recommends you let the bill payer know this will be happening, unless this form payment refund is not possible in which I will contact the bill payers email in order to establish a refund via Paypal with the original bill payer. *Paypal will be used as a secure form of payment as this only requires an email address and receipts are easily available for both parties to acknowledge as evidence of a refund payment. When issuing refunds via Paypal it’s up to the customer in order to provide the correct email address and if they do not and the transaction cannot be cancelled the customer is liable for this.*

Exchanges
Following the return steps above having received the item here at ERQD and been addressed what item the product is to be exchanged with *subject to availability* this will be dispatched to the customer. *Dispatch times will be at ERQD discretion, but will be communicated to the customer.*

Stockist Returns
Regrettably if you have bought an ERQD product through another retailer not directly on ERQD Etsy's or Sum Up Store pages,  please contact the retailer to see what their policy is on returns & exchanges.
